Sri Lanka’s Genocidal War 2006 – 2009, As Seen By The World

Though Sri Lanka unleashed its agenda of marginalization of Tamils, from 1956 through a program of Budddhisisation and Sinhalisation and a hidden genocide process, the climax was reached during the war against the Liberation Tigers of Tamil Eelam (LTTE) from 2006 – 2009 culminating in the genocide of Tamils, keenly watched by the United Nations and the International Community.

Their deadly and deliberate silence encouraged Mahinda Rajapaksa who rightly construed it as a tacit approval to proceed with the massacre of innocents in this war without witness.

Once the genocide was accomplished, the International Community and United Nations rushed for the damage controlling actions, statements, accusations, resolutions, investigations, etc, all of which were only condemning and consoling messages for the lives of more than 100,000 Tamil civilians who were cut down for no reason except because they were Tamils, targeted for liquidation to make Sri Lanka a Sinhala-Buddhist State.

This article quotes the numerous comments and statements of various International Organizations, UN Officials, Human Rights Activists, and intellectuals, etc. It is the hope of the traumatised Tamils that at the least, accountability followed by appropriate punishment will be meted out to the perpetrators of the crime of genocide and upholding justice as a minimum to heal the wounds of victims who are still waiting and hoping against hope for appropriate remedies and justice.

The crown of all statements is that of the late President of Singapore Lee Kuan Yew, the world’s second best statesman after Nelson Mandela who created one of the world’s most prosperous nations Singapore from scratch. He methodically and meticulously bonded the Chinese, Malays, Indian and others numbering three million [77% Chinese, 14% Malays, 8% Indians & 1% others] as Singaporeans and not as Chinaporeans by weeding out racism, communalism, chauvinism or majority hegemony which are the hallmarks in Sri Lanka since independence from 1948.

In 2010, immediately after the war Lee Kuan Yew, who in 1948 wished to make Singapore like the prosperous and peaceful Ceylon, made his correct assessment of Mahinda Rajapaksa in ten words. “Rajapaksa is a Sinhala extremist and he will never change,” an opinion all the Tamil leaders and all communities must keep in mind when dealing with Rajapaksa, as judged by Lee Kuan Yew.

However, the proximate cause of all the political turmoil in Sri Lanka was the unrealistic and parochial blunder committed by Great Britain when it dismantled and destroyed the separate Kingdoms of the then existing Kingdom of Jaffna, Kotte and Kandy which existed until 1833 and brought the Sinhalese and Tamils under one central rule in Colombo.

This was admitted by the UK Conservative party member Dr. Rachel Joyce who apologised on March 2009 and admitted the “error of colonial Britain in making a unitary Ceylon out of two nations the Tamil and Sinhalese. The Tamil people have lived on the island for millennia in their own contiguous, distinct geographically territory. The three million Tamils of the island constituted a self-governing nation until occupied by colonial powers in particular Britain who amalgamated them with the Sinhalese nation purely for convenience and administration”.

Sri Lankan Government’s Commissions and Omissions:

 

Commissions:


International crimes – including genocide in all forms [structural, cultural, religious] Ref: Genocide Resolution passed unanimously in the Northern Provincial Council of Sri Lanka in February 2015.

 

Enforced disappearances.
Arbitrary arrests and detention.
Forcible return of internally displaced.
Culture of impunity.
Ongoing human rights violations
Dismissing and ignoring the daily and continuing cries and pleas of relatives of disappeared/owners of seized land.

 

 

Omissions:


Failure to implement the UNHRC Recommendations in the October 1st 2015 Resolution.
Failure to set up the Office of Missing Persons, The OMP legislation is likely to be shelved.
Failure to set up any judicial mechanism, internal or otherwise to prosecute perpetrators of war crimes etc.
Failure to honor several promises made to foreign dignitaries and local Tamil leadership like the:-

1. Release of political prisoners, and lands unjustly occupied by security forces, no reduction of the Army presence in the Northern Province.
2. Repeal of the draconian Prevention of Terrorism Act [PTA] is yet to materialize according to international norms.
3. Foot dragging in the making of new constitution.
4. No clear stand or proposal to solve the ethnic problem.
5. No investigation as to the 65,000 or more missing, possibly it will never be.

 

 

It is time for the International Community and United Nations to come to terms with Sri Lanka’s real intention, lest another round of turmoil may become to unstoppable.

Will Sri Lanka continue to pursue the present policy of majoritarian hegemony leading to ultimate national disintegration or switch to the pragmatic policy of true reconciliation towards building a united Sri Lanka under a two nations federal system?

    Very clear and informative article for anyone to understand the real situation in Sri Lanka and the mindset of Majority Buddhist Sinhalese governments since independence. As Father of the Tamil Nation [Eelam ] Late S. J. V. Chelvanayagam said at his last stage after all peaceful agitation were crushed by brutal force "GOD ONLY CAN SAVE THE TAMILS". It seems his predictions is coming true: The GODS wrath and curse and tears of brutally massacred [including infants, elderly, women and wounded] will never go unanswered. The continuing natural disasters and the economic downfall and international pressure for justice and rule of law is causing the ruling elite to spend sleepless nights and worries about their future. [not about the country} My3 and Rnill are on tour to see the world fearing that this is going to be their last opportunity. The prayers and trust in God of the oppressed is working and it is working slowly but surely, justice will prevail at last.

    However much we condemn the HR violations in Sri Lanka, the Sinhalese community will be prepared to maintain their supremacy over other communities. In Singapore, Tamil is an official language, and the contributions by different communities contributed to the growth of Singapore. Sri Lanka, the beautiful island has undergone several naturals disasters such a Tsunami, Cyclone., Earth slips, Floods. I would say that it is a punishment by God for the Karma performed by the Buddhist Sinhalese. In addition to natural disasters, communal riots and burning of Jaffna library are men made destruction. The British government made the biggest mistake when they left the Island. They should have separated the island into Eelam and Sri Lanka, in the same way, they created Pakistan and India. They should have at least combined North and Eastern provinces and created a federal state, along with Kandy, Sothern and western states. For the last seven decades, several amendments were brought in the constitution, and many are to safeguard the interest of Major Sinhalese community. UN and any western countries have closed their eyes. The government of Sri Lanka is showed to use the tactics of delay in solving the crisis. It will take much more decades before a solution is found

    Once again Mr. Kanagasabai has outlined his expertise in writing with full of facts to global leaders and readers, stressing on the need for an international independent investigation and delivery of Justice through foreign judges as successive Sri Lankan Sinhala regimes have been failing since the British colonial rulers left the shores in 1948. Mr. Kanagsabai, being an academic and legal expert provided supporting evidences of call for strong action by global leaders, International community, human rights groups and others in his article to provide merit to his writings. Not only Tamils but also all those who strongly believe in democracy, freedom, human rights, rule of law, R2P, fundamental rights, respect to other races and religions will demand for an international independent investigation, justice to put an end to racial madness against Tamils. International community must consider that Tamils lived in sovereign state Eelam, Tamil nation and lived peacefully for centuries prior to Western colonialism. Western colonialism that merged Eelam with Sinhala Land for easy administration and Tamils never had any issues under British colonial rule as there were rule of law, equality and Justice. As successive Sinhala regimes failed to respect rule of law, respect and treat everyone equally, use of state forces against minorities, interfere with state machinery (recent Haiti sex scandal exposes Sri Lankan forces crimes) and highly politicized environment, it is clear that no Sri Lankan regime will investigate state forces crimes and deliver fair Justice that is acceptable to all. Delay by International community to act firmly only increases more human sufferings, destruction, refugees, loss of life and hatred. God bless victims!
